Our West Palm Beach and Fort Lauderdale DUI defense lawyers at the Law Offices of Leifert & Leifert know that Memorial Day Weekend is one of the business times of year in South Florida, especially in terms of DUI accidents and arrests.
The increase in DUI arrests is not necessarily due to the increase in DUI-related incidents that take place during the holiday weekend; as we know, it’s during this weekend in particular that police departments throughout South Florida and throughout the country set-up DUI checkpoints to catch drunk drivers.

As we discussed earlier this year, though, many Floridians have been giving law enforcement officers difficulty at these checkpoints by providing the necessary information without giving police the opportunity to smell their breath or hear them speak. Whether or not these tactics will work during this DUI-crackdown weekend has yet to be seen.

Our Palm Beach and Broward County DUI defense attorneys know that DUI/sobriety checkpoints are ubiquitous throughout the Sunshine State, and while they tend to pop up more during major holiday weekends, they’re still commonplace even during non-holiday times.
These checkpoints, not surprisingly, lead to an increase in DUI arrests. The problem is, however, that not everyone arrested for DUI is technically over the legal limit; police often have the authority to place an individual under arrest and haul them off to jail if they suspect impairment based on slurred words and/or the smell of alcohol on one’s breath.

As has been reported in national news recently, Floridians are increasingly becoming aware of their rights under the law — and refusing to actually speak to police officers during DUI checks.

As Americans prepare to celebrate the Fourth of July, and America’s independence, law enforcement departments all over the country gear up for increased numbers of sobriety checkpoints and DUI arrests.
Our Palm Beach and Broward County DUI defense attorneys know that local police departments have historically ramped-up DUI crackdowns during July 4th, espcially when the holiday falls on a weekend or, as is the case this year, when it creates an extended weekend.

With more drivers on the road and more local bars and restaurants hosting events and offering drink specials, the likelihood of drunk drivers being on the road increases; as such, so does the number of police officers looking to catch them.

tweeting_checkpoints.jpgOur Fort Lauderdale DUI defense attorneys read an article about the increasing number of young people who broadcast the location of DUI checkpoints on social networking sites like Twitter and Facebook. While it’s not illegal, the practice has some police concerned, because they worry that making information about DUI checkpoints public could cause some drunk drivers to choose an alternate route.

In fact, Mexico City police are so concerned about the trend that they are threatening fines and jail time to people to post the location of DUI checkpoints. But some DUI defense lawyers say that could violate freedom of speech.

Others say the trend doesn’t pose a problem, because it raises awareness about the consequences of drunk driving. Plus, checkpoint locations often change after a few hours anyway.
